Terms of Service

These Terms of Service (“Terms”) govern your access to and use of sureflowleads.com (the “Site”) and the services provided by SureFlow (“SureFlow,” “we,” “us,” or “our”), including websites, automated call & text-back, review generation, and B2B lead-generation (collectively, the “Services”). By accessing the Site or using the Services, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Services. If you use the Services on behalf of a business, you represent that you are authorized to bind that business to these Terms.

2. The Services

SureFlow provides marketing and business-growth tools and services. Specific deliverables, scope, and pricing for client engagements are set out in a separate order form, proposal, or written agreement (an “Order”). If an Order conflicts with these Terms, the Order controls for that engagement.

3. Accounts

You are responsible for the accuracy of the information you provide and for maintaining the confidentiality and security of any account credentials. You are responsible for all activity under your account.

4. Fees & billing

  • Fees, billing frequency, and payment terms are described in your Order. Unless stated otherwise, fees are billed in advance and are non-refundable except as required by law.
  • Third-party pass-through costs (such as domains, phone numbers, or messaging fees) may be billed at cost and itemized.
  • Late or failed payments may result in suspension of the Services.

5. Acceptable use

You agree not to use the Services to:

  • Violate any law or regulation, including marketing, telemarketing, email (CAN-SPAM), and text-messaging (TCPA / A2P 10DLC) rules.
  • Send unlawful, deceptive, harassing, or unsolicited communications, or message recipients who have not provided the required consent.
  • Infringe the intellectual property or privacy rights of others.
  • Introduce malware, attempt to gain unauthorized access, or interfere with the Services.

6. Client responsibilities & compliance

Where SureFlow sends communications on your behalf, you are responsible for having a lawful basis and any required consent to contact your customers and leads, and for the accuracy of contact lists you provide. You agree to honor opt-out requests promptly. You are responsible for the content and claims you approve for use.

7. Intellectual property

SureFlow retains all rights in the Site, our software, templates, and methods. Subject to full payment, final deliverables produced specifically for you under an Order are yours to use as described in that Order. You retain ownership of content and materials you provide to us and grant us a license to use them to deliver the Services.

8. Third-party services

The Services may rely on or integrate with third-party platforms (for example, hosting, analytics, chat, and CRM providers such as LeadConnector / HighLevel). Your use of those platforms may be subject to their own terms, and we are not responsible for third-party services.

9. Disclaimers

The Site and Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted or error-free, or that they will produce any specific business result, ranking, lead volume, or revenue. Any examples, figures, or illustrations are for demonstration only and are not guarantees.

10. Limitation of liability

To the maximum extent permitted by law, SureFlow will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability arising out of or relating to the Services will not exceed the amounts you paid to us for the Services in the three (3) months before the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless SureFlow from claims, damages, and expenses (including reasonable attorneys’ fees) arising out of your content, your contact lists, your use of the Services, or your violation of these Terms or applicable law.

12. Termination

Either party may terminate an engagement as described in the applicable Order. We may suspend or terminate access to the Site or Services if you breach these Terms or use the Services unlawfully. Provisions that by their nature should survive termination will survive.

13. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. The exclusive venue for disputes will be the state and federal courts located in Harris County, Texas, unless otherwise required by law.

14. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and revise the “Last updated” date above. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
